WHAT IS A GRANT OF LETTERS OF ADMINISTRATION?

The Grant is an official court document confirming that the person named in the Grant is responsible for the administration of a deceased’s estate (e.g. bank accounts, property, accommodation bonds, etc).

DO I NEED PROBATE AS WELL?

No, Grants of Probate are for Wills that validly appoint an Executor.  You apply for a Grant of Letters of Administration where the deceased died without a Will or if the named Executors in a Will cannot (or do not want to) act.

CAN I APPLY FOR A GRANT OF LETTERS OF ADMINISTRATION?

It depends.  The law determines who can apply for the Grant and who will have priority if multiple people wish to apply for the Grant.
